CBLDF Appeals Retailer Conviction - Store Manager Sentenced to Six Months in Jail

Basically this guy sold an adult comic to an adult. The adult section was carefully marked, monitored and you had to be an adult to buy anything from it. There's no suggestion that he was even letting kids browse them.

However, since the store was close to an elementary school, he was convicted. I think an extract from the prosecutors argument sums up the real reasons behind the case:

"Comic books, traditionally what we think of, are for kids. This is in a store directly across from an elementary school and it is put in a medium, in a forum, to directly appeal to kids. That is why we are here, ladies and gentlemen. I want to re-emphasize that the fact that all this smut is out there, does not mean it's acceptable and is decent by our community. We're here to get this off the shelf."

It's the line immediately preceding the one you quote that scares me:

"I don't care what type of evidence or what type of testimony is out there, use your rationality, use your common sense."

A prosecutor directly appealing to the jury to ignore the evidence and vote their prejudices. That, to me, is far more horrifying and offensive than Legend of the Overfiend could ever be.

Almost all of the privately owned comic shops that I've been to have had adult themed sections to the store. Not one of them ever let kids roam freely near the sections and always had age verification and warnings listed nearby. I just don't understand what the big deal is.

And if this is such a problem then should we expect to see the same things happening in conveniance stores that stock adult materials in the top of magazine racks?

Has anyone here seen the comic? Are we talking about R-rated stuff or X-rated stuff?

I'm thinking of giving ten bucks to the CBLDF. I'd be surprised if the U.S. supreme court would even hear the case, so I'm sure it won't get that far, but it's a shame this kind of thing still happens.

and someone else described it as a "tentacle rape epic". So I'm guessing not quite my cup of tea, though probably not worse than Overfiend and certainly not worse than a lot of the live-action porn out there.
