Use of flashing lights by Police vehicle

I sent the following, last Saturday afternoon, to the Police Complaints email address I found on the website of my local Police force. It's self expananatory:

"Earlier this afternoon, at about 1.30pm, Saturday 17/5/08, I was waiting to walk across XXX St., a few hundred metres west of the intersection with XXXX Terrace. There was quite a lot of traffic queued facing east at a red light and, at a break in the centre island on XXXXX St. a police vehicle facing the opposite direction was waiting to do a U-turn, but this was obviously not being facilitated with as much ease as the driver wished as there was no break in traffic to allow this manoeuvre.

So on came the flashing lights atop the vehicle, causing other vehicles to stop as they approached and let the police car turn and, then, with lights still flashing, vehicles were persuaded to either pull aside or close up to others in front of them to create a big enough gap for the police vehicle to cross 2 lanes and enter a car park to their left. I watched, assuming they were going to cut through the car park to avoid the lights and carry on down XXX Terrace about some business, but no. The vehicle was then parked and a uniformed officer got out and went into the Subway takeaway to order himself some lunch!

I was left wondering about the legality of this sequence of events. Surely the flashing lights are meant to be used in emergency situations and the power to make other vehicles get out of the way is something that should be reserved for some sort of police business, not to speed up entry to a takeaway to buy a sandwich. Consequently I took note of the registration of the police vehicle, which is XXX-XXX, and decided to bring this matter to the attention of some appropriate authority.

To be honest, I'm getting a bit sick of this sort of thing. It feels like bullying, throwing weight and authority around unnecessarily. As a resident of XXXX Terrace I quite often witness police vehicles travelling up the road in the wrong direction (ie. on the wrong side of the traffic island opposite the XXXX Hotel) for something like 20 to 30 metres in order to perform nothing more important than, again, access the Subway store across the road there, but this usually just causes me to laugh, being fully aware that should they see anyone else do exactly the same thing then the driver would be pulled over and fined. The use of the flashing lights to facilitate the same objective, however, seemed one step too far for me to be amused by it.

I got an official letter in the post today, informing me that my complaint had been referred to the "Internal Investigations Branch" and that I would soon be receiving a phone call from an officer to initiate a "conciliation process".

I'm scared!

If you get this kind of thing happening regularly, try to make sure you get the registration and/or the car number. They'll know who was in that car at that date and time and the complaint is that much surer to hit its target. Independent witnesses also = WIN.

(In fact I wish people were programmed from school age to think in that kind of order should they see something like this: make a note of everything that's identifiable, get independent witnesses before they leave the scene. You don't have to do it in all circumstances - few people really want to live in 1984 - but at least it'll be forefront in your mind and you'll have those courses of action there as an option, rather than it not occurring to you.)

Yeah, blue and twos should be for emergencies only. In fact most special police powers concernig the use of their vehicle (including where to park) are for operational purposes only and most can only be used if there's a legitimate reason. Hope the officer concerned gets spoken to for it.

How about contacting your local MP and letting the police complaints department know that you have done so. If I were you I'd be tempted to mention to the MP (and perhaps the police complaints department) that the press could well be interested in a story like that.

Seriously, though, the kind of activity those cops were engaging in is bloody dangerous, irresponsible, and a blatant abuse of powers.

Hey the LAST thing we need here in Adelaide, Australia is more murders! We already have a reputation for being the "bizarre murder capital of the world". Yet, given the standards of our media, this really is the sort of thing they could happily cover for days!

Anyway, it's interesting to see that others share my opinion of what happened and yes, I got the cars number, but I didn't get the names of witnesses. Didn't occur to me despite the fact that there was a couple walking towards me at the time and the girl made a remark and the boyfriend told her "they do that ALL the time!"

I just hate the idea of now having to deal officially with the police internal investigation department whose objective is, apparently, to "conciliate the matter" which, on my understanding of the word, means they just want to make me feel better about the whole thing.

Or else they're just going to tell you to go find a war protest to join, and "conciliation" is a euphemism.

I got a phone call from an Investigating Officer with regard to my complaint, who was friendly and courteous and told me, with what sounded like his tongue planted firmly in his cheek, that the ofiicers in question had a different version of the story. According to them they had, only minutes before, pulled a car over for a traffic offence and "forgotten to turn the flashing lights off". Hmmmmm... I pointed out to him that the car had been sitting stationery, waiting for a gap in traffic, for at least half a minute that I observed before the lights came on and I was therefore not particularly convinced by that story. He informed me that the logs did show that a car had been pulled over by them only a minute before the time I mentioned but I countered that I was giving only an aproximate time and that it could just have easily been 10 minutes later. He seemed amused to be honest, which is fine because I was too at this stage. He asked if I was happy with the explanation supplied and I said I was, that at least they'd been informed that their actions hadn't gone unnoticed and they'd probably have second thoughts before doing it again.

Then we moved on to the bit about the police cars driving up the wong side of the road and he told me that there would be a meeting held where it would be made clear to all that this action had been noticed and that it would not be tolerated. Emphasis would be given to the concept that police vehicles were not to be undertaking actions on the road that was not allowed to the rest of the public and they would all receive warning about unauthorised use of the lights as well. He also added that he, personally, didn't approve of officers behaving in such a way and would be telling them so himself.

So that was good. Nobody gets in real trouble which means that I don't end up having to worry that I might get victimised or whatever...

next week, timelord solves the middle east peace crisis and later in the year will have george bush and osama bin laden reconciled and eating jelly bean ice cream together as they accept their joint nobel peace prize!

good work, timelord. i have written to two firms in my city complaining about their worker's appalling driving - one as i was a cyclist - but have not received the courtesy of a reply. at least the constabulary made some small effort...
