I have wondered about this since I bought this album with no idea what to expect when I was a sophmore or something, circa when it came out. Had never heard them b4. Still love it to this day, but this mystery persists, not sure why I never thought to ask here b4. track listing is 1-9 then 11 and in the linear notes it says "song 10 is missing?". Always wondered if it was somehow hidden somewhere on the disc or at leaast what this is in reference to? ( perhaps just to haunt someone with a question everytime they listened to the album, eh?)

Any info, thoughts, suggestions, input of any kind appreciated.

I think I remember reading about this in an interview - something about not getting clearance for a sample, so they took it off the album and leaked it to the bootleggers instead. I don't have my old goth mags handy (it might've been Permission??), but the story's probably online.

Or I could be entirely wrong.

Score one for the internet: you can read about it here, at the entry for Last Rights (about halfway down).

In brief, the problem was with a sample of Timothy Leary, which he gave his personal permission to use - but he didn't own the copyright to the recording. Track 10, "Left Hand Shake," has been released in several bootleg editions, so you might be able to track it down (and it's almost certainly out there on the filesharing networks).
