This appears to be a slightly re-drawn cover - the skull bits are indeed missing. It's no swipe, though - it is very clearly signed by Ethan Van Sciver.

If memory serves, the gesture on the body is different, as is the mask. The background setting remains the same.

I was just talking to an indie comic artist who's done some work for Marvel and he was saying how Marvel (and DC too, I would assume) is infamous for re-drawing LOTS of art (using their touch-up/corrections artists). Maybe this is what happened here. Funny to be using an Ethan cover months after Ethan is off the book -- also funny since this image seemed to be in earlier solicits, right?

Anyway, glad to see the paragraph description of the issue's contents -- more Xorn spotlight, and Dusk the Muslim mutant is back!!!

Well, Marvel does own the artwork that they hired Ethan to draw for them. As long as they pay him a royalty (assuming that was part of the contract), they can alter the work in any way they want, and publish it as they see fit.

It's the same art, with the skull bits removed (probably at Grant's request) and completely recolored. They told me they were going to use it a few months ago, when I politely asked for the art back. I'm glad they did, but again, the art is miscredited in the solicitation. Sigh. I can picture Phil Jimenez jumping for joy at this, the same way Frank Quitely must have with those busts that were mentioned earlier on this thread.

Oh yeah, about the mask. That cover was drawn when Xorn's design wasn't quite finalized yet. If you look at Lenil's annual, the mask Xorn wears throughout only actually appears as it does now in one or two panels. It seems to kind of morph, with shadow, etc. My initial thought when asked to put a final Xorn together was to completely change his mask entirely, and work an X into it somehow (clumsily, I admit). Then I talked to Frank Quitely, and he suggested that Xorn have sockets all over the top of his head remaining from being a prisoner. So I went and redrew the cover to #124, with the finalized Xorn mask, as close to Lenil's as possible. My Xorn had some equipment on his chest to enable safely opening his mask if need be, but when FQ added/changed the design, he took those off and just had a bare chest with chains, the version you have now.
New X-Men was fun for that reason. It was a total collaboration in a lot of respects.
