Janne, a friend of mine runs the Swedish site flashback.se, and is thinking of starting up something similar in English, hosted in the UK.
He is worried about falling foul of UK law on what he can and cannot publish here in good ol' Blighty. He is always being taken to court in Sweden, wins most of the cases, so has a good working knowledge of what goes in Sweden, but does not have the resources (or the desire) to be fighting cases here.
Here is his worry list:
A.) What websites is it illegal to publish a link to?
(These rules are very different country by country. In Sweden it is illegal to link to child porn and prostitution, but otherwise
most things are OK. But [in Sweden] they have special laws for advertisment. So it's illegal to have banners to (Internet) Casinos - except if they are owned by Swedish government).
B.) What kind of pictures is it illegal to publish on a British website? (Do you need disclaimers, if the website in controversial?)
C.) What rules exist in the UK for Internet forums & webchats?
(In Sweden everything is legal, but you need to have an mailbox for
"abuse". If anyone posts illegal information, you have to take the
illegal information away when you are informed. The owner of the
website is never responsible for what other people do, if they take
away things who are illegal.)
I advised him as far as I could - my area of expertise is more print based publications controlled by an editor etc. and told him what I knew about libel, blasphemy and the obscenity laws we have. I thought they would be the three biggest areas he was ever likley to contravene.
I didn't want to PM Tom (who must have run into these issues) as he
is busy enough.
I had a look at the uk.legal groups etc. on Google, but they are only ever generalisations, and Janne really needs specifics.
