Legally speaking, a work is copyrighted as soon as it is created; most legal cases are based on either registration of copyright (that is, proof positive someone made something they say they made), or on definition of a new work -- is this sample really being recontextualized enough that it's a new thing and not just the same song done over again?

Also, isn't the idea of copyright antithetical to the core concept of the EFF, that information wants to be free?

I always understood copywrite law to funtion the instant some creation is publicly displayed with the " © " symbol.

If you make something in your garage and never show it to anyone, then someone displays a similar creation publicly with that symbol... that person would theoreticly have the copywrite even if you created it first.

as I understand it at least.
